Welcome to PixaGlow. These Terms of Service ("Terms") govern your access to and use of the PixaGlow platform, embeddable widget, dashboard, and related services (collectively, the "Service"). By signing up for or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, embedding the PixaGlow widget, or otherwise using the Service, you confirm that you have read, understood, and accepted these Terms and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.
2. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
This means Paddle is responsible for billing, collecting applicable sales tax / VAT / GST, payment processing, fraud screening, and refunds in accordance with our Refund Policy.
3. Subscription & Billing
- Monthly plan: $199 USD per month, billed monthly and renewing automatically until cancelled.
- Annual plan: $1,980 USD per year, billed annually and renewing automatically until cancelled.
- All prices are exclusive of taxes; applicable taxes are calculated and collected by Paddle at checkout.
- You authorize Paddle to charge your payment method on each renewal date until you cancel.
- Cancellation, refund eligibility, and prorated access are governed by our Refund Policy.
4. Usage & Fair Use Policy
The "Unlimited Growth Plan" is offered subject to a Business Fair Use Policy. To prevent automated abuse and protect service quality for all customers, normal commercial use is capped at 1,000 simulations per month per spa account. Usage that materially exceeds this threshold, or that appears to originate from automated scripts, scrapers, or non-human traffic, may be rate-limited or suspended at our discretion.
5. Medical Disclaimer
PixaGlow provides Aesthetic Simulations for visual consultation purposes only. The Service does not provide medical advice, diagnosis, treatment recommendations, or guaranteed surgical or cosmetic outcomes. Simulations are AI-generated visualizations and may differ materially from actual results. Always consult a licensed medical professional before pursuing any procedure.
6. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, for all activity under your account, for ensuring your end users have provided any consents required by applicable law (including for the upload of facial images), and for the accuracy of business information you provide.
7. Intellectual Property
The PixaGlow platform, brand, software, and underlying models are owned by PixaGlow and protected by intellectual property law. You retain ownership of content you or your end users upload, and grant PixaGlow a limited license to process that content solely to provide the Service.
8. Limitation of Liability
To the maximum extent permitted by law, PixaGlow's aggregate liability for any claim arising out of or relating to the Service is limited to the amounts paid by you to Paddle for the Service in the twelve (12) months preceding the claim. PixaGlow is not liable for indirect, incidental, consequential, or punitive damages.
9. Termination
You may cancel your subscription at any time from your dashboard. We may suspend or terminate accounts that violate these Terms, the Fair Use Policy, or applicable law.
10. Governing Law
These Terms are governed by the laws of the State of New York, United States. Disputes will be resolved in the competent courts located in New York, NY.
